Terms of Service

In plain terms: NEURL-OS is a free self-assessment tool for adults. It is not medical advice. Use it to plan your week, not to make health decisions. You own your answers; we own the platform. We provide it as-is and our liability is limited.

These Terms of Service ("Terms") are an agreement between you and Xhibitur LLC ("we", "us", "our"), a New York limited liability company, governing your use of NEURL-OS at neurl-os.com and any partner-branded version of it (the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old to use NEURL-OS. By using it you represent that you are 18 or older and that you have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organisation — as part of a team programme, for example — you represent that you have authority to bind that organisation to these Terms.

2. What the Service is

NEURL-OS asks you a set of questions once a week about sleep, workload, movement, stress, attention and fuel. It applies a scoring model to your answers and returns a score, a projection of where that score is trending, and suggested areas of focus.

The score is generated by a deterministic weighted model that combines your current answers with the pattern of your previous weeks. It reflects what you reported. It is a structured way to look at your own self-assessment — not a measurement taken from your body, and not a clinical instrument.

3. Not medical advice

NEURL-OS is not a medical device, a diagnostic tool, or a healthcare service. It does not diagnose, treat, cure or prevent any condition, including burnout, and it is not a substitute for advice from a qualified physician, therapist or other healthcare professional.

Never disregard professional medical advice, or delay seeking it, because of something you read in NEURL-OS. If you think you may have a medical or mental health emergency, contact your doctor or emergency services immediately.

Your score is not a health assessment and must not be used to make medical decisions, to assess anyone's fitness for work, or as a factor in any employment decision.

4. No employment or evaluative use

If you are an organisation using NEURL-OS with a team, you agree that you will not use scores, group averages or any other output of the Service:

to make hiring, firing, promotion, compensation or disciplinary decisions
to evaluate any individual's performance or capability
to compel participation, or to penalise anyone who declines to take part
to attempt to identify an individual's responses from aggregate figures

Participation must be voluntary. We may suspend access to any organisation we reasonably believe is using the Service in breach of this section.

5. Your information and your content

Your calibration answers are yours. Most of them never leave your device — see the Privacy Policy for what is stored where.

Where you do send us information — by joining a group board, opting in to email, or enabling notifications — you grant us a limited licence to use it solely to operate the Service as described in the Privacy Policy. We do not sell it and we do not claim ownership of it.

You are responsible for what you enter. Do not enter information about anyone other than yourself, and do not enter a display name that impersonates another person or organisation.

6. Acceptable use

You agree not to:

use the Service for any unlawful purpose, or in breach of any applicable regulation
attempt to gain unauthorised access to any part of the Service, its administrative functions, or its underlying infrastructure
probe, scan or test the vulnerability of the Service, or defeat any security or rate-limiting measure
submit automated, scripted or deliberately false entries, including to distort a group board
scrape, harvest or systematically extract data from the Service
reverse engineer the scoring model, or copy the Service to build a competing product
resell, sublicense or commercially redistribute the Service without our written permission
interfere with anyone else's use of the Service

7. Group and team boards

Joining a group board is voluntary. When you join, your score and dimension scores are used to calculate that group's averages, subject to the protections in the Privacy Policy — including that no average is shown until at least five people have taken part.

You may leave a board at any time by emailing info@neurl-os.com. Group organisers see aggregate figures only and cannot see your individual results.

8. Partner programmes

Some organisations offer NEURL-OS under their own branding. A partner's branding does not make that partner a party to these Terms, and does not mean we endorse that partner or that the partner endorses any claim we make. Any separate agreement between you and a partner is between you and them.

Paid partner and team engagements are governed by a separate written agreement. Where that agreement conflicts with these Terms, that agreement controls for the parties to it.

9. Our intellectual property

The Service — including the NEURL-OS name, the scoring model, the interface, the copy, the design system and all associated materials — is owned by Xhibitur LLC and protected by intellectual property law. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service for your own purposes. They give you no other rights.

10. Availability and changes

NEURL-OS is offered free of charge and we may change, suspend or discontinue any part of it at any time, with or without notice. We do not guarantee that the Service will be available without interruption or error.

Because your history is stored on your own device, you are responsible for retaining anything you want to keep. We hold no backup of it and cannot recover it if your browser data is cleared or your device is lost.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, XHIBITUR LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We make no warranty that the Service will be uninterrupted, secure or error-free, that any score, projection or recommendation is accurate or suitable for your circumstances, or that using the Service will produce any particular outcome.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, XHIBITUR LLC AND ITS MEMBERS, OFFICERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.

13. Indemnity

You agree to indemnify and hold harmless Xhibitur LLC and its members, officers and agents from any claim, demand, loss or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

14. Termination

You may stop using the Service at any time; clearing your site data removes your local history. We may suspend or terminate your access at any time if we reasonably believe you have breached these Terms or are placing the Service or its users at risk. Sections 5, 9, 11, 12, 13, 15 and 16 survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. You and Xhibitur LLC agree that any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in New York, and you consent to the jurisdiction of those courts.

Before filing any claim, you agree to contact us at info@neurl-os.com and attempt in good faith to resolve the matter informally for at least 30 days.

16. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
Severability. If any provision is held unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.

17. Changes to these Terms

We may update these Terms. If we do, we will change the date at the top of this page, and for significant changes we will give notice on the site before they take effect. Continuing to use the Service after a change means you accept the updated Terms.
